Terms of Use

1. Who you are agreeing with

These terms are an agreement between you and Frekvens AS, Norway (“we”, “us”), the developer of Newsleep (“the app”). By downloading or using the app you accept them. The app is distributed through Apple's App Store, so Apple's Licensed Application End User License Agreement also applies. Where these terms say more than Apple's, ours apply between you and us; Apple is not a party to these terms and has no obligation to provide support for the app.

2. Your licence

We grant you a personal, non-exclusive, non-transferable licence to install and use the app on Apple devices you own or control, as permitted by the App Store's usage rules. You may not copy, modify, distribute, sell, rent, reverse-engineer or otherwise extract the app's source, sound engine or recordings, except where the law expressly allows it.

3. The free minutes

Every night the app gives you 15 minutes of playback with every soundscape, every layer and every control, free of charge. When the free window ends, the sound fades out over about a minute and the app shows the pay-once screen. “Not now” is a real exit. The window resets each night. We may change the length of the free window for new users in future versions; we will not remove the free window without notice.

4. The one-time purchase

• What it is. One non-consumable in-app purchase, “Newsleep forever”, which removes the nightly free-minute limit for as long as the app is available. It includes every soundscape, every recording, every layer and every control that exists in the app at the time of purchase and any we add later.
• Price. The price is shown in the App Store in your local currency before you buy. At launch it is US$9.99 or the local equivalent. We may change the price for future buyers; a purchase you have already made is not affected.
• No subscription. There is no recurring charge, no trial that converts to a charge, and no automatic renewal of any kind.
• Payment. Apple processes the payment under your Apple ID and its own terms. We do not receive your payment details.
• Restoring. The purchase is tied to your Apple ID. Use “Restore purchases” on the pay-once screen or in Settings to restore it on another iPhone or after reinstalling.
• Refunds. Refunds are handled by Apple, not by us, because Apple takes the payment. Ask at reportaproblem.apple.com. Your statutory rights as a consumer are not affected. Because the purchase is digital content delivered immediately, you agree that delivery begins as soon as the purchase completes.

5. What Newsleep is not

Newsleep is a sound machine that plays recordings of rain, weather, water, fire, rooms and noise. It is not a medical device, it does not diagnose, treat, cure or prevent any condition, and nothing in the app or on this website is medical advice. If you have tinnitus, hyperacusis, hearing loss or another hearing or sleep concern, or if your symptoms are new or changing, talk to a doctor or an audiologist. Words like “ringing relief” describe a sound control, not a treatment.

6. The recordings

The recordings in the app are licensed to us or owned by us and are for listening inside the app only. You may not extract, copy, re-record, distribute or sell them, or use them in your own works.

6a. Hearing safety

Loud sound for long periods can damage hearing, whatever the source. You are responsible for the volume you choose. Keep the level low: just below your ringing, or just over the room. A speaker is generally kinder than earbuds for many hours. Do not use the app in a way that keeps you from hearing alarms or other sounds you need to hear.

7. Availability and changes

We may update the app, add, replace or remove recordings, soundscapes and controls, and fix bugs. We may stop distributing the app if we have to, though we will do our best to keep an app you have paid for working on the iOS versions it supported when you bought it. The app depends on your device, your iOS version and Apple's services, none of which we control.

8. Warranty and liability

The app is provided “as is”. To the extent the law allows, we make no promises that it will meet your needs or run without interruption or error, and we are not liable for indirect or consequential loss, including lost sleep. Where liability cannot be excluded, our total liability to you is limited to the amount you paid for the app. Nothing in these terms limits rights that consumer law gives you and that cannot be waived, including rights under the Norwegian Consumer Purchases Act and, for consumers in the EU and EEA, your local consumer protection law.

9. Privacy

How the app handles data is described in the Privacy Policy, which is part of these terms.

10. Governing law

These terms are governed by Norwegian law. Disputes are resolved by the courts of Norway, unless you are a consumer with a right to bring proceedings in your own country. Consumers in the EU may also use the European Commission's online dispute resolution platform.

11. Changes to these terms

If we change these terms we will update the date at the top of this page. Continuing to use the app after a change means you accept the new terms. Changes will not take away a purchase you have already made.
